You may have heard that the US Food and Drug Administration (FDA) met Friday 5/31/19 for a hearing to talk about CBD for the first time, but what does this mean?

Farm Bill of 2018

First, let’s talk about a little thing called the 2018 Farm Bill. A new farm bill passes every 5 years regarding food, agriculture, trade and much more. The 2018 Farm Bill legalized industrialized hemp by taking it off the list of controlled substances. This allows states and farmers to produce hemp under strict guidelines, which wasn’t allowed before.

Retail Regulation

After the farm bill, a lot of hemp-based products were sold in stores and online. This was the case for hemp, but because CBD is viewed more as a drug, it’s placed under FDA regulation. This is why we haven’t seen CBD added to a lot of food and beverages just yet. Once CBD is legalized at the federal level there is no doubt we will be seeing CBD in all kinds of food products.

The FDA has concerns about the CBD market being so unregulated and that’s exactly why they held this first-ever public hearing. The FDA wants a say in how CBD products are labeled to ensure correct product information. For example, the amount of CBD that is actually in the product. This seems totally fair and every CBD company should be doing this already, so we are all for it!

The FDA also wants to regulate the marketing and advertising of CBD so companies can’t have false claims about their products.
